Parental Kidnapping Orlando Parental Kidnapping Attorney

Florida Child Relocation Lawyer

For most parents, the thought of losing parental rights or precious time with their child is terrifying. But the fact is that if you move away with your child to another state without following Florida’s family court relocation procedures, your fears may become a reality. For other parents, these are the very things they fear when the other parent moves away with the child or suddenly removes the child from the state without warning.

Parental kidnapping is a serious concern and can have a lifelong impact on your relationship with your child. Whether you need assistance with relocation approval or with having your child brought back to Florida after the other parent has fled the state without warning, the law office of Timothy W. Terry, Attorney at Law, can help you. With more than 30 years of experience serving the needs of families just like yours, we have the experience, compassion, and skill to assist you.

An initial consultation is available to you at no charge.

In order for a parent to move out of state with the child or move more than 50 miles away from the other parent, the parent must first seek court approval for the relocation or request the written consent of the other parent. While it is understandable that there are valid reasons that warrant a move out of state, the court must be assured that the move is in the best interests of the child and will not restrict the parental rights of the other parent.

If a parent moves out of state without obtaining prior approval from the court or other parent, the parent may be required to return with the child until the relocation matter is resolved. Additionally, the issue of removing the child from the state without permission — parental kidnapping — may be held against the parent in relocation proceedings or in a separate proceeding to modify the existing shared parenting plan.

Our law firm is available to serve the needs of either parent involved in a relocation or parental kidnapping case in Florida. To talk to an attorney in more detail about your case, e-mail or call us at 407-495-2399.
