In order for a parent to move out of state with the child or move more than 50 miles away from the other parent, the parent must first seek court approval for the relocation or request the written consent of the other parent. While it is understandable that there are valid reasons that warrant a move out of state, the court must be assured that the move is in the best interests of the child and will not restrict the parental rights of the other parent.

If a parent moves out of state without obtaining prior approval from the court or other parent, the parent may be required to return with the child until the relocation matter is resolved.
