Why You Should Still Use an Attorney for an Uncontested Divorce

While some divorce cases are lengthy and intense battles, dissolving a marriage need not always be so contentious. The state of Florida recognizes uncontested divorces in which both parties agree to dissolving the marriage. Further, the parties also agree on the reason(s) that the marriage must end and are in accord as to the financial distributions and all matters concerning minor children as well.

In uncontested cases, the divorce process is simplified and takes less time to complete. Many people going through a divorce prefer that the matter be uncontested so that they can move on with their lives with the least possible disruption. While the parties need not be represented by counsel, one should still hire an attorney for an uncontested divorce for the following reasons:

  • Legal complexity — Even the simplest divorces can become complicated. There are a wide variety of considerations surrounding property distribution, spousal support, child support, parenting plans, etc. While the parties may agree on matters that they have previously discussed, they may not be fully aware of or fully understand the implications of their divorce accord. Having competent divorce counsel will ensure that every relevant issue is fully addressed and understood.
  • Future issues — A divorce agreement can, and likely will, affect both parties for years after the marriage is dissolved. The terms of the agreement may affect a former spouse’s income tax rates and potential deductions. For example, how support payments are allocated can easily impact a former spouse’s future income tax burden. The results of property division decisions can also affect each party’s creditworthiness. A competent divorce lawyer will make sure that the client is fully aware of the potential consequences of every action.
  • Deteriorating relations — Many couples initiate divorce agreeing upon the majority of relevant decisions. However, it is common for the cooperative relationship between spouses to falter during the dissolution process. What was initially a simple uncontested divorce can devolve into a protracted battle as terms are discussed in depth. Having counsel on both sides may help prevent the parties from arguing over finances, child rearing, etc. An experienced lawyer will know how the court is likely rule on a wide variety of issues. Insightful legal guidance can help the parties reach workable solutions.
